Chief Justice Paul Baffoe-Bonnie has ruled that the petitions seeking the removal of the Chairperson and deputies of the Electoral Commission, as well as the Special Prosecutor, do not disclose a prima facie case warranting further investigation or removal proceedings.<\/p>\n\n\n\n
A Presidency statement dated February 18, 2026, said President John Dramani Mahama had, on November 25, 2025, referred seven petitions against Electoral Commission Chairperson Jean Mensa and her deputies and three petitions against Special Prosecutor Kissi Agyebeng to the Chief Justice. The referral was effected pursuant to Article 146 of the 1992 Constitution and Section 15 of the Office of the Special Prosecutor Act, 2017 (Act 959), to determine whether the submissions established a prima facie case.<\/p>\n\n\n\n
By correspondence dated January 26, 2026, the Chief Justice advised the President that the material supplied by the petitioners did not, in his view, disclose a prima facie case to justify further investigative or removal proceedings against the named officeholders.<\/p>\n\n\n\n
